Mental Health Fraud Recommendations

1. To prevent more fraud, clinical and financial audits of all government-run and private psychiatric facilities that receive government subsidies or insurance payments to ensure accountability and the compilation of statistics on admissions, treatment and deaths, without breaching patient confidentiality.

2. A list of convicted psychiatrists and mental health workers, especially those convicted and/or disciplined for fraud and sexual abuse should be kept on state, national and international law enforcement and police agencies databases, to prevent criminally convicted and/or deregistered mental health practitioners from gaining employment elsewhere in the mental health field.

3. In every country criminal codes must state that just the fact of a sexual act between any therapist and patient is "felony rape" with the same penalties as any other rape. "Consent" by the patient is not a defense. Click here for Model Sexual Exploitation by Therapist Law.

4. Every country should establish or increase the number of psychiatric fraud investigation units to recover funds that are defrauded in the mental health system.

5. All professional licensing boards for psychiatrists, psychologists or psychotherapists should refer copies of patient complaints about sexual abuse to the police to investigate and prosecute.

6. Psychiatric evidence should be removed from the courts. Let the judges and jurors decide questions of criminal intent as they did before psychiatrists introduced illogical ideas about what it is "right or wrong."
