RECOMMENDED REFORMS

1. State and federal legislators should repeal laws permitting the insanity defense and diminished capacity pleas.

2. Judges, attorneys or law enforcement officers need to ensure that psychiatric evidence is removed from the courts and that psychiatrists and psychologists are no longer afforded “expert” status. Let the judges and jurors decide questions of criminal intent as they did before psychiatrists introduced illogical ideas about what it is “right or wrong.”

3. Remove psychiatrists and psychologists as advisors or as counselors from police forces, prisons and criminal rehabilitation and parole services.

4. A list of convicted psychiatrists and mental health workers, especially those convicted and/or disciplined for fraud and sexual abuse should be kept on state, national and international law enforcement and police agencies databases, to prevent criminally convicted and/or deregistered mental health practitioners from gaining employment elsewhere in the mental health field.

5. In every country, criminal codes must state that just the fact of a sexual act between any therapist and patient is “felony rape” with the same penalties as any other rape. “Consent” by the patient is not a defense.

6. All professional licensing boards for psychiatrists, psychologists or psychotherapists, should refer copies of patient complaints about sexual abuse to the police to investigate and prosecute.

7. Courts should not compel children to undergo psychiatric or psychological assessment or treatment.

8. It must be recognized that no adult should be court ordered to undergo psychiatric assessment or treatment, as there is no science to substantiate the assessment or the treatment methods employed and no scientific evidence to verify the workability of the treatments, nor their ability to even help.
